These Terms & Conditions (“Terms”) govern your access to and use of the Coffee Pass India mobile application (“App”) and related services operated by Coffee Pass India (“Coffee Pass”, “Company”, “we”, “us”, or “our”).

By creating an account or using the App, you agree to be legally bound by these Terms.

If you do not agree, please do not use the App.

1. About Coffee Pass India

Coffee Pass India is a service-based digital platform that offers users access to structured discount benefits at partner cafés through the purchase of a Coffee Pass.

Coffee Pass does not manufacture, sell, or deliver food or beverages. All food and beverage services are provided directly by independent partner cafés.

2. Eligibility

To use the App:

• You must provide accurate and complete registration information
• You must not have been previously suspended or terminate.
  
  We reserve the right to refuse access at our discretion.

3. Nature of Service

• A Coffee Pass provides access to a defined number of digital discount vouchers.
• Each voucher entitles the user to a specified discount (e.g., 22%) on selected coffees at participating cafés.
• Vouchers are:
• Valid only within the stated validity period
• Non-transferable
• Redeemable only once
• Subject to café-specific restrictions

All offers are subject to availability and partner participation.

4. Account Responsibility

You are responsible for:

• Maintaining confidentiality of your login credentials
• All activity under your account
• Ensuring vouchers are not misused, duplicated, or shared

You must immediately notify us of any unauthorized use.

5. Payments

• All purchases are prepaid and processed via secure third-party payment gateways.
• Prices are displayed inclusive of applicable taxes.
• Coffee Pass reserves the right to modify pricing at any time.

Completion of payment constitutes acceptance of these Terms.

6. NO REFUND POLICY

Due to the digital and service-based nature of Coffee Pass:

• All purchases are final.
• No refunds, cancellations, or partial refunds will be provided once a Coffee Pass is purchased.
• Unused vouchers cannot be refunded, exchanged, or carried forward beyond their validity period.

Exceptions may be made only where required under applicable law.

7. Fraud, Misuse & Termination Rights

Coffee Pass maintains a strict zero-tolerance policy for misuse.

We reserve the right to immediately suspend or permanently terminate an account without refund if we detect:

• Attempted duplication or manipulation of vouchers
• Sharing login credentials with multiple users
• Redeeming vouchers through deceptive or dishonest means
• Collusion with café staff to exploit the system
• Use of automated tools, bots, or unauthorized software
• Providing false information during registration
• Any activity deemed fraudulent, abusive, or harmful to the platform

In such cases:

• Access to the App will be revoked
• Remaining vouchers will be forfeited
• No refund will be issued
• Legal action may be initiated if necessary

Our determination of fraud or misuse shall be final and binding.

8. Suspension of Services

We may suspend or modify the App:

• For maintenance or technical updates
• Due to legal or regulatory requirements
• If partner café participation changes
• In cases of misuse or policy violation

We are not liable for temporary unavailability.

9. Partner Café Disclaimer

Partner cafés are independent businesses.

Coffee Pass:

• Does not control café operations
• Is not responsible for service quality
• Does not guarantee product availability
• Is not liable for disputes between users and cafés

All food and beverage services are the sole responsibility of the café.

10. Intellectual Property

All content, logos, trademarks, and materials within the App are the property of Coffee Pass India.

You may not:

• Copy, modify, distribute, or reproduce content
• Reverse-engineer the App
• Use branding without written permission

11. Limitation of Liability

To the fullest extent permitted by law:

Coffee Pass shall not be liable for:

• Indirect or consequential damages
• Loss of savings or expected benefits
• Café refusal due to policy violation
• Service interruptions
• Technical errors beyond reasonable control

Our total liability shall not exceed the amount paid by you for the Coffee Pass.

12. Indemnification

You agree to indemnify and hold Coffee Pass harmless from claims, damages, losses, or expenses arising from:

• Violation of these Terms
• Fraudulent activity
• Misuse of the App

13. Modifications to Terms

We reserve the right to modify these Terms at any time.

Updated Terms will be posted within the App. Continued use constitutes acceptance of changes.

14. Governing Law & Jurisdiction

These Terms shall be governed by the laws of India.

Any disputes shall be subject to the exclusive jurisdiction of the courts of Delhi, India.
